Nop, it's Mark. Derek always wear designed (I mean, with boats, ferrys, water, etc.) scrub caps and Mark doesn't.
Plus this picture is the episode when Mark caught Addie and Alex going in the on call room and makes a pass at Mer before surgery in order to "get over" the fact that Addie broke their no sex with other people promise. So if anyone saw the episode knows that in that scene, it's Mark, not Derek.
If I'm not wrong, it's 3x21, Desire. Derek was sorta avoiding Mer in the episode.
